Kids Yoga Network™ (hereinafter referred to as “Kids Yoga Network" or ”KYN” or "us" or "we") provides this website, www.kidsyoganetwork.com and all related content and services (collectively, the "Site") subject to your compliance with the terms and conditions set forth in this Terms of Service ("TOS").

This Terms of Use Agreement sets forth the standards of use of the Kids Yoga Network Online Service for Registered Members. By using the KidsYogaNetwork.com website you (the “Member”) or you (the “Paying Member”) agree to these terms and conditions. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of this website.

We reserve the right, at any time:
• To modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted at KidsYogaNetwork.com website.
• To change the Site, including eliminating or discontinuing any content on or feature of the Site.
• To change any fees or charges associated with use of the Site or for any products or services offered for sale or otherwise available on the Site.
Your continued use of the Service after amendments are posted constitutes an acknowledgement and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.
1. Description of Service
Kids Yoga Network™ is an on-line community designed for parents, moms to-be, educators, yoga and other therapy providers, lightworkers for children, holistic product innovators, and enlightened event promoters. Some areas of the site are also designed for children, with a game section and tween and teen articles.  KYN is providing Member with access to forums, articles, teleconferencing, on-line partner store, find a teacher directory, find an event directory, product directory, ability to view members inspiring stories and yoga photographs or to upload their own.

Making Purchases or Placing Listing of Your Services, Products or Events in Kids Yoga Network Directories.  Certain products, events or services may be offered for sale on the Site. You may be asked by Kids Yoga Network or the applicable third party to supply certain information, including, but not limited to, credit card or other payment information. You agree to provide Kids Yoga Network or such third party with information that is accurate, complete and current, and to comply with the terms and conditions of any agreement that you enter in connection with your purchase of any product or service. You are responsible for all charges incurred by users of your account, credit card or other payment mechanism, as well as for paying any applicable taxes.

‘Service Listings’. Certain Paying Members are provided the ability to advertise and promote their services to members and visitors in various ways on Kids Yoga Network™.  All membership fees are annual and must be paid in full, and be up to date, before entries to the Directories will be listed.  All information offered must be accurate and correct.  It is Paying Members responsibility to regularly update their own information listed in the directories and this facilitate is available to Paying Members as part of their Service Listing. Only entry’s aligned with the vision of Kids Yoga Network will be permitted within the Kids Yoga Network™ Directories.  Kids Yoga Network™ holds the right to terminate, without notice, any paying members contract if they are advertising services, products or events, which are not in line with the vision of Kids Yoga Network™ and or are obscene and or offensive to other members or visitors to KYN.

Kids Yoga Network™ offers Service Listings to paying members such as those that offer holistic services for children, families, prenatal and postnatal.

Descriptions, images or listings of, or links or references to, products, services or events on the Site Service Listings do not imply Kids Yoga Network's endorsement of such products, services or events.  We reserve the right, without prior notification, to change such Service Listings (including without limitation any prices, or benefits associated with membership for Service Listings).

Forums and Teleconferences. Kids Yoga Network™ hosts forums and teleconferences on the Site. Members are expected to abide by the Rules of Conduct that are set forth at http://www.KidsYogaNetwork.com/aboutus/rules. Any member failing to comply with the Rules of Conduct or Terms of Service may be expel from forums or teleconferences on the Site. Kids Yoga Network may terminate or restrict such Member's continued access to the Site. Kids Yoga Network is under no obligation to monitor Members or Paying Members forums.  However, you acknowledge and agree that we have the right (but not the obligation) to monitor the Site, your Website postings; to alter or remove any such materials; and to disclose such materials and the circumstances surrounding their transmission to any third party in order to operate the Site properly; to protect ourselves, our sponsors, and our Members, Paying Members and visitors; and to comply with legal obligations or governmental requests.
2. Disclaimer of Warranties
The site is provided by Kids Yoga Network™ on an “as is” and on an “as available” basis. To the fullest extent permitted by applicable law, Kids Yoga Network™ makes no representations or warranties of any kind, express or implied, regarding the use or the results of this web site in terms of its correctness, accuracy, reliability, or otherwise.  Kids Yoga Network™ shall have no liability for any interruptions in the use of this Website.  Kids Yoga Network™ disclaims all warranties with regard to the information provided, including the implied warranties of merchantability and fitness for a particular purpose, and non-infringement. ßSome jurisdictions do not allow the exclusion of implied warranties, therefore the above-referenced exclusion is inapplicable.
3. Disclaimer Regarding Links and Member Websites

The Site may provide links to other Internet websites or resources ("Linked Sites") as part of our Service Listings or other Sponsored Advertisements. Kids Yoga Network™ neither controls nor endorses such Linked Sites, nor have we reviewed or approved any content that appears on such Linked Sites. You acknowledge and agree that Kids Yoga Network™ is not responsible for the legality, accuracy, or inappropriate nature of any content, advertising, products or other materials on or available from any Linked Sites.  You further acknowledge and agree that Kids Yoga Network™ shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods and services available on or through any Linked Site.
4. Limitation of Liability

KIDS YOGA NETWORK™ SHALL NOT be liable for any damages whatsoever, and in particular KIDS YOGA NETWORK™, SIOBHAN WILCOX OR ANY PERSON SUBMITTING ARTICLE(S) FOR PUBLIC VIEWING ON KIDS YOGA NETWORK™ shall not be liable for any special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to this web site or the information contained in it, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if KIDS YOGA NETWORK™ has been advised of the possibility of such damages. 5. Indemnification
Member, Paying Member and visitor agrees to indemnify and hold Kids Yoga Network™, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of Member’s and or Paying Member use of the Service, the violation of this Agreement, or infringement by Member and or Paying Member, or other user of the Service using Member’s or Paying Member’s computer, of any intellectual property or any other right of any person or entity.
6. Members Account
All Members, Paying and Non-Paying, of the Service shall receive a password and an account.  Members are entirely responsible for any and all activities, which occur under their account whether authorized or not authorized. Member agrees to notify Kids Yoga Network™ of any unauthorized use of Member’s account or any other breach of security known or should be known to the Member. Member’s right to use the Service is personal to the Member. Member agrees not to resell or make any commercial use of the Service without the express written consent of Kids Yoga Network™.
7. Modifications and Interruptions to Service
Kids Yoga Network™ reserves the right to modify or discontinue the Service with or without notice to the Member. Kids Yoga Network™ shall not be liable to Member or any third party should Kids Yoga Network™ exercise its right to modify or discontinue the Service. Member acknowledges and accepts that Kids Yoga Network™ does not guarantee continuous, uninterrupted or secure access to our website and operation of our website may be interfered with or adversely affected by numerous factors or circumstances outside of our control.
8. Disclaimer Regarding Accuracy of Vendor Information
Product specifications or Service Listings and other information have either been provided by the Vendors or Service Providers or collected from publicly available sources. While Kids Yoga Network™ makes every effort to ensure that the information on this website is accurate, we can make no representations or warranties as to the accuracy or reliability of any information provided on this website.

Our website is operated and provided in the State of California. Although Kids Yoga Network™ is a global website and we have service listings and products from different states and countries, we make no representation that our website or other services are appropriate, legal or available for use in other locations. Member assumes all knowledge of applicable law and is responsible for compliance with any such laws. Member may not use the Service in any way that violates applicable state, federal, or international laws, regulations or other government requirements. Member further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation.

13. Botnets
Kids Yoga Network™ retains the right, at our sole discretion, to terminate any accounts involved with botnets and related activities. If any hostnames are used as command and control points for botnets, Kids Yoga Network™ reserves the right to direct the involved hostnames to a honeypot, loopback address, logging facility, or any other destination at our discretion.
14. Other Terms
If any provision of this Terms of Use Agreement shall be unlawful, void or unenforceable for any reason, the other provisions (and any partially-enforceable provision) shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent. You agree that this Terms of Use Agreement and any other agreements referenced herein may be assigned by Kids Yoga Network™, in our sole discretion, to a third party in the event of a merger or acquisition. This Terms of Use Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between us in relation to your participation as a Member. Member agrees that by accepting this Terms of Use Agreement, Member is consenting to the use and disclosure of their personally identifiable information and other practices described in our Privacy Policy Statement.
